Our litigation and alternative dispute resolution attorneys represent clients in virtually all kinds of disputes in district, state, federal, international, and special court proceedings and have helped their clients secure important victories before state supreme courts and before the United States Supreme Court. They also represent clients in alternative dispute resolution procedures such as mediation and arbitration. Our firm’s practice is focused on commercial and product liability litigation, and we represent parties in all stages of a dispute, from pre-litigation counselling through trial.

  • Representation of a world-famous rock-band in an ongoing high-profile federal copyright and partnership action.
  • Lead litigation counsel for a UK Fortune 500 pharmaceutical company in reversing a federal court order denying dismissal and transfer to the English High Court in a multimillion-dollar drug production dispute.
  • Representation of Google as the intervenor in the 337 investigation initiated by Nokia against HTC involving smartphones and tablets for the Android Operating System. Four of the five patents were disposed before hearing, and the ALJ found non-infringement of the last remaining patent after the hearing.
  • Representation of the University of California Los Angeles in connection with a contract dispute.
  • Representation, as North American litigation counsel, of BGI Genomics Co., Ltd. in connection with high-profile patent infringement litigation brought by Illumina.
  • Lead counsel defending a software and hardware service provider in a high-profile federal court copyright and false advertising action brought by a major U.S. original equipment manufacturer, including pursuit of antitrust counterclaims.
  • Successfully appealed the remaining portion of a subrogation action against a major liability insurer for failure to defend the insured in an action involving defective microprocessor chips to the Ninth Circuit Court of Appeals, winning a unanimous reversal of the district court’s decision, and an additional $7.5 million award.
  • Lead counsel for an executive plaintiff in a shareholder derivative, fraud and partition action, including a 9-day trial resulting in a complete victory and award of significant damages, punitive damages, and partition grant to the client.
  • Defended a major supermarket chain in a complex federal court consumer rights class action.
  • Representation of a Chinese manufacturer of storage products for one of the largest retailers in the United States. Successfully obtained a $4.3 million jury verdict against the plaintiff in an international commercial dispute involving claims for breach of contract.
  • Defending an architect against a $15 million construction defect claim involving an adaptive reuse of an industrial building.
  • Representation of an international offshore drilling contractor based in Singapore in litigation worth over $60 million concerning the drilling of an exploratory well offshore Guinea involving highly complex technical issues concerning drilling operations.
  • Representation of a high net worth individual in connection with a dispute with an EB5 fund in which he had invested.
  • Obtaining four complete defense verdicts on behalf of a nationwide mortgage lender (more than US$1 billion in closed loan volume) in civil jury trials alleging mortgage fraud, violations of RESPA, and conspiracy with a mortgage broker and others to inflate appraisals to defraud homeowners in mortgage transactions.
  • Defense of Taiwanese helicopter manufacturer, Align Corporation Limited, in relation to product liability lawsuits and claims by consumers who were injured after purchasing the product from a secondhand distributor.
  • Representing major international manufacturers of tobacco, vape, and related products in connection with the successful defense of litigation in the UK, Ireland, continental Europe, India, and the Middle East, working in each case with leading barristers, advocates, solicitors, and other lawyers, as well as in-house counsel.

Alternative Dispute Resolution

Our alternative dispute resolution attorneys help clients resolve conflicts outside of traditional litigation. We have successfully represented clients including multinational companies and sovereigns in mediations and arbitrations both in the United States and internationally. We represent clients in major international arbitrations before organizations including LCIA, UNCITRAL, ICTY, the ICC, and others.  We also represent our clients in the United States in relation to all kinds of disputes, including contract, intellectual property, and employment issues.

Selected Experience

  • Representation of a major Russian energy company in relation to a dispute with a Central European state concerning discrimination and expropriation of a $2.65 billion inward investment in the energy sector, including advice as to proposed bilateral investment treaty (BIT) arbitration proceedings.
  • Acting for a major European telecom company in an ICC arbitration in relation to services in the Middle East.
  • Representation of Alipay US, a subsidiary of Ant Financial, in employment litigation and arbitration related to the company’s alleged wrongful termination of an employee. Initially filed in federal court, we successfully had the dispute transferred to arbitration, where we ultimately arrived at a favorable settlement for the client.
  • Advising AT&T Wireless on a US$50 million Indian tax dispute and associated litigation arising out of an offshore transaction. As part of that representation, we also acted on the client’s decisive intervention in the related US$4.4 billion Vodafone case before the Indian Supreme Court. In its judgment in the Vodafone case, the Supreme Court found in favor of investors, and in so doing relied significantly on arguments advanced by our client. Work included assistance in drafting Indian pleadings, research and advice to client.
  • Representation of Petrobras in a $500 million English litigation concerning cost claims and recovery of loans relating to the construction of a production platform, P36.
  • Representation of a major multinational Chinese electronics manufacturer in connection with the review of its licensing agreement with the resolution, without litigation, of a licensing dispute with Dolby.
  • Represented a U.S. air cargo company in an ICC arbitration relating to the termination of its Southeast Asian agent due to corruption allegations.
  • Representation of clients in administrative proceedings before the Colombian Customs Authority (DIAN) in relation to customs valuation issues, controversies of origin, tariff classification, payment of royalties and apprehensions and seizures.
  • Representation of a real estate-focused investment fund in connection with an arbitration claim by certain investors against the firm, its general partner, and others, alleging that the fund had been mismanaged.
  • Successfully defended a leading e-commerce company in arbitration concerning whistleblower claims of former employees.
  • Lead counsel defending a leading electronic payment processing company in employment litigation and arbitration.
  • Representation of a mobile start-up company in a mediation concerning defense of claims by its former CEO that he was owed six figures in stock and deferred compensation.
  • Represented major securities firm in fraudulent conveyance trial and securities arbitration arising from margin trading by foreign investor.
  • Acting in a United Nations Commission on International Trade Law (UNCITRAL) arbitration against a Central American state on behalf of a U.S. private investment firm in relation to a technically complex oil exploration license dispute.
  • Representation of an Israeli chemical company in a $100 million London Court of International Arbitration (LCIA) concerning a gas sale and purchase agreement with a U.S. energy company.
  • Obtained a multi-million-dollar arbitration award in favor of an aerospace manufacturer in connection with the sale of a business.
  • Successfully defended a university in a multi-million-dollar contractual arbitration relating to the rental of a campus venue.
  • Acting as lead counsel to the Republic of Croatia before the Appellate Chamber of the International Criminal Tribunal for the former Yugoslavia (“ICTY”) in its case against Ante Gotovina. The case which resulted in reversal of the Trial Chamber and a successful outcome for Croatia.
  • Representation of well-known film producer in connection with a successful arbitration over who owns motion picture and other rights to “To Kill a Mockingbird” and “Watchman.”
  • Acting as court-appointed arbitrator and mediator in New York state and federal courts.
