Arbitration and Mediation

Our practice advises and represents clients in arbitration, mediation, and other types of alternative dispute resolution proceedings, including both international arbitration and US arbitration.  Our attorneys advise and represent clients in all aspects of dispute resolution including the negotiation and drafting of arbitration agreements, advising on risk management and the pros and cons of various arbitral bodies, representing claimants and respondents in arbitrations, and enforcing both domestic and international arbitration awards.   We have represented clients involved in arbitrations and alternative dispute resolution proceedings across a broad array of industries including telecom,  financial services, pharmaceuticals, aerospace/military aircraft, construction, technology, education, real estate, and government affairs.  Our attorneys have represented clients before most major arbitration bodies, including the International Centre for Settlement of Investment Disputes (ICSID), the ICC, the International Court of Arbitration, the China International Economic and Trade Arbitration Commission, the Singapore International Arbitration Centre (SIAC), JAMS, ADR, the Center for Mediation and Arbitration of Paris (CMAP), and the American Arbitration Association.

Our attorneys have experience serving as arbitrators and mediators, including as arbitrators of the International Institute of Conflict Resolution and the American Arbitration Association.

Selected Experience

  • Advised a large Turkish bank in conjunction with an ICSID dispute for the protection of a $90 million guarantee it had provided for the construction of a highway in Pakistan.
  • Advanced the claims of a Middle Eastern company against a Taiwanese entity in a SIAC arbitration.
  • Defended a government against claims being asserted by a Middle Eastern investor in an ad hoc arbitration under the UNCITRAL rules.
  • Prosecuted the claims of a French contractor against a South American government arising out of the construction of a power plant in an ICC arbitration.
  • Obtained multi-million dollar arbitration award in favor of aerospace manufacturer in connection with the sale of a business.
  • Successfully defended leading e-commerce company in arbitration of “whistleblower” claims of former employees.
  • Represented leading securities brokerage firms and investors in numerous arbitrations of multi-million dollar customer complaints.
  • Successfully defended pipe and sewer restoration company in arbitration of patent false marking claims.
  • Defended a U.S. exporter of high-technology equipment to China from claims by a Chinese purchaser who did not operate the equipment as specified in a CIETAC arbitration.
  • Prosecuted claim for major military aerospace company against major general aircraft manufacturer regarding multi-million dollar fuselage modifications in support of international military aircraft requirements.
  • Represented a Middle-East commercial agent against a French group within the scope of CMAP arbitration dealing with termination and compliance issues.
  • Advised a Swiss Tour operator having been expropriated in Africa within the scope of an ICC arbitration.
  • Represented a Greek client against a French contracting partner within the scope of an ICC arbitration focused on warranties and product liability issues.
  • Won multi-million arbitration for large wire rope manufacturer from San Francisco-based computer company for breach of contract and professional negligence in the installation of a specialized software system.
  • Represented a major Eastern European energy company in relation to a dispute with a Central European state concerning discrimination and expropriation of a $2.65 billion inward investment in the energy sector, including advice as to proposed bilateral investment treaty (BIT) arbitration proceedings.
  • Acting for a major European telecom company in an ICC arbitration in relation to services in the Middle East.
  • Represented a U.S. air cargo company in an ICC arbitration relating to the termination of its Southeast Asian agent due to corruption allegations.
  • Represented a real estate-focused investment fund in connection with an arbitration claim by certain investors against the firm, its general partner, and others, alleging that the fund had been mismanaged.
  • Successfully defended a leading e-commerce company in arbitration concerning whistleblower claims of former employees.
  • Lead counsel defending a leading electronic payment processing company in employment litigation and arbitration.
  • Represented major securities firm in fraudulent conveyance trial and securities arbitration arising from margin trading by a foreign investor.
  • Acting in a United Nations Commission on International Trade Law (UNCITRAL) arbitration against a Central American state on behalf of a U.S. private investment firm in relation to a technically complex oil exploration license dispute.
  • Represented an Israeli chemical company in a $100 million London Court of International Arbitration (LCIA) concerning a gas sale and purchase agreement with a U.S. energy company.
  • Obtained a multi-million-dollar arbitration award in favor of an aerospace manufacturer in connection with the sale of a business.
  • Successfully defended a university in a multi-million-dollar contractual arbitration relating to the rental of a campus venue.
  • Represented a mobile start-up company in a mediation concerning the defense of claims by its former CEO that he was owed six figures in stock and deferred compensation.
  • Representation of a Saudi Arabian security company in a mediation against a major telecommunications company in France.
  • Advising and representing clients in the context of CMAP mediations.
  • Represented researcher in connection with claims arising from a laboratory’s investigation into scientific misconduct which were resolved by mediation.
  • Representation of a family in mediation related to a $6 million loan that was never reimbursed.
