John Mussman, Partner at Rimon Law, discussed at the Chicago Bar Association recent developments in fair credit law, including last summer’s Supreme Court decision in Inclusive Communities. In that case, the Court recognized disparate income claims under the Fair Housing Act. He briefly cases in lower courts exploring the reasoning in Inclusive Communities, particularly the requirement that there be “robust causality” between the government or company action and the adverse discriminatory effect. John also discussed anticipated Supreme Court decision in Hawkins which will establish whether the term “applicant” may include  “guarantors” under the Equal Credit Opportunity Act and Regulation B. Finally, he exposed important Department of Justice and Consumer Finance Protection Bureau consent orders entered into with a lender in the auto finance space.
