New Prop 65 Warning Regulations

A process that began over three years ago to “reform” Proposition 65 with the goal of curbing “shakedown lawsuits” by bounty hunter plaintiffs has concluded with California approving new regulations that will now require significant changes in both the state-approved language used to deliver “safe harbor” Prop 65 warnings to avoid violation of the law, and in the way in which the warnings may be conveyed.  Far from reducing meritless Prop 65 litigation, however, these new changes may very well represent an increased burden and expense on companies doing business in California without enhancing safety because they could lead to alleged violations over the technicalities in the new regulations.
