Mark Lee, partner at Rimon, was recently quoted in a Bloomberg Law article examining how online platforms like YouTube are navigating the growing challenges posed by AI-generated deepfakes and evolving platform liability laws.
In the article, Lee discusses the lack of a clear legal framework incentivizing platforms to proactively address deepfake content, particularly compared to copyright enforcement under the Digital Millennium Copyright Act (DMCA).
“YouTube was heavily encouraged to create its copyright tool by the Digital Millennium Copyright Act safe harbor for platforms that take certain steps to fight infringement,” Lee explained. “There’s no such legal encouragement for the detection tool” for deepfakes.
His commentary highlights the complex legal and practical questions platforms face as AI-generated content becomes increasingly sophisticated, raising issues around intellectual property, publicity rights, free speech, and content moderation.
